Indefinite leave to remain – calculating continuous period in UK

In most cases, before applying for Indefinite Leave to Remain, you must accrue a 5-year continuous lawful period in the UK. In this time, you must be in employment, or active in the UK economy before being eligible to qualify.

Here’s what you need to know.

  • The period between entry clearance being issued and entering the UK may be counted towards the qualifying period
  • Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period
  • With applications made from 11 January 2018, absences from the UK must be considered on a rolling basis rather than in separate consecutive 12-month periods
  • Innovators, Global Talent, Tier 1 entrepreneurs’/investors’/exceptional talents’ may be eligible to apply before the 5-year period under special circumstances
